1. About these terms
Datavey is operated by Kyros Software Ltd (“we”, “us”), a private limited company registered in England and Wales, company number 16915277, registered office 82a James Carter Road, Mildenhall, Bury St Edmunds, IP28 7DE, United Kingdom.
These terms cover the waitlist only. You accept them when you tick the box on a waitlist form. If you are later invited to create an account, verify your identity or take part in tasks, separate terms will apply and we will ask you to accept them at that point. How we use your personal data is explained in our Privacy Policy.
2. Joining the waitlist
- You must be 18 or over to join the worker waitlist.
- One entry per person. You may join the worker waitlist only once, as yourself, using an email address that belongs to you. Entries that are duplicates, including those using variations of the same email address, will be removed.
- The information you give us must be true and accurate, and you must keep it up to date.
- Your entry only counts once you have confirmed your email address using the link we send you. The link expires after 48 hours, and you can ask for a new one. Unconfirmed entries are deleted after 30 days.
- We may refuse or remove an entry if we reasonably believe it breaks these terms.
3. No guarantee of access or paid work
Joining the waitlist does not guarantee that you will be invited to Datavey, that you will be able to create an account or pass verification, or that any tasks or paid work will be available to you. We invite people in stages, and who we invite and when depends on things like demand from companies, your country, your languages and your device, as well as your place in the queue. Any information we give you about your position is a guide, not a promise.
Being on the waitlist does not make you an employee or worker of Kyros Software Ltd.
4. Your place in the queue and referrals
- Your starting place in the queue is based on when you signed up.
- Once you confirm your email address, you receive a personal referral link. Each person who joins the worker waitlist using your link and confirms their email address moves you up 50 places. Unconfirmed sign-ups do not count.
- Self-referrals do not count. This includes referring yourself with another email address, and sign-ups made from the same internet connection as you.
- You must not create fake entries, pay or reward people to sign up with your link, use automated tools to generate sign-ups, or share your link in spam, unsolicited messages or in any way that breaks the rules of the platform where you share it. You must not suggest that you speak for Datavey.
- Fraudulent referrals are removed. If we reasonably believe referrals are fake, duplicated or obtained in breach of these terms, we may remove them, reset your position, or remove your entry altogether.
- Referrals and queue positions have no cash value and cannot be transferred, sold or exchanged.
5. Company requests
Submitting the company form is a request to talk to us. It does not create a contract or commit either of us to anything. If we agree to work together, our services will be provided under a separate written agreement. Please do not send us confidential information through the form; we are happy to agree confidentiality terms before you share details of your project.
6. Fair use
When using the waitlist and our website, you must not:
- use bots, scripts or other automated means to submit forms or create entries;
- use disposable or temporary email addresses, or email addresses that are not yours;
- try to get around our security checks, rate limits or duplicate detection;
- interfere with, disrupt or try to gain unauthorised access to our website or systems.
7. Changes to the waitlist and these terms
We may change how the waitlist works, including how places are calculated, or pause or close the waitlist at any time. We may also update these terms. Each version has a version number shown at the top of this page, and we record which version you accepted. If we make a significant change that affects you, we will email you before it takes effect. If you do not agree to a change, you can leave the waitlist at any time.
If we close the waitlist, we will delete waitlist data as described in our Privacy Policy.
8. Leaving the waitlist
You can leave at any time using the link in any email we send you. Your details are deleted straight away. You can also email [email protected].
9. Our liability
The waitlist and our website are provided free of charge. We take reasonable care to keep them available and accurate, but we do not promise that they will always be available or free from errors.
We are not liable for any loss of profit, income, business or opportunity, or for any indirect or consequential loss, arising from your use of the waitlist or from not being invited or offered work. Subject to the paragraph below, our total liability to you in connection with the waitlist is limited to £100.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales. If you are a consumer, nothing in these terms affects your statutory rights.
10. General
- These terms are between you and Kyros Software Ltd. Nobody else has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
- If any part of these terms is found to be unenforceable, the rest will continue to apply.
- If we do not enforce a term straight away, we can still enforce it later.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
